P., devidamente preenchido com os seguintes dados identificativos da Mediadora, at\u00e9 5 dias \u00fateis antes da sua utiliza\u00e7\u00e3o, para o correio eletr\u00f3nico do IMPIC, I. P., dispon\u00edvel em cmi@impic.pt:\u00a0a) Identifica\u00e7\u00e3o completa da empresa de media\u00e7\u00e3o imobili\u00e1ria, nomeadamente designa\u00e7\u00e3o social, NIPC, sede social e n\u00famero de licen\u00e7a AMI junto do IMPIC, I. P.; b) Endere\u00e7o eletr\u00f3nico de contacto da entidade.<\/li>\n<li>O IMPIC, I. P., disponibiliza, no respetivo s\u00edtio da Internet, uma vers\u00e3o em suporte digital do modelo de contrato de media\u00e7\u00e3o imobili\u00e1ria com cl\u00e1usulas contratuais gerais de media\u00e7\u00e3o imobili\u00e1ria, para consulta e recolha pelos interessados.<\/li>\n<\/ol>\n<h4>Procedimento de valida\u00e7\u00e3o de contratos n\u00e3o dispensados<\/h4>\n<ol>\n<li>Est\u00e3o sujeitos a aprova\u00e7\u00e3o pr\u00e9via pelo IMPIC, I. P., os modelos de contrato de media\u00e7\u00e3o imobili\u00e1ria com cl\u00e1usulas contratuais gerais.<\/li>\n<li>Para efeitos do disposto no n\u00famero anterior, as empresas de media\u00e7\u00e3o imobili\u00e1ria devem proceder \u00e0 comunica\u00e7\u00e3o do modelo de contrato antes do in\u00edcio da sua utiliza\u00e7\u00e3o, bem como \u00e0 comunica\u00e7\u00e3o das ulteriores altera\u00e7\u00f5es.<\/li>\n<li>A comunica\u00e7\u00e3o pr\u00e9via do modelo de contrato \u00e9 efetuada atrav\u00e9s do envio para o endere\u00e7o de correio eletr\u00f3nico do IMPIC, I. P., dispon\u00edvel em cmi@impic.pt, acompanhado dos seguintes elementos: a) Identifica\u00e7\u00e3o completa da empresa de media\u00e7\u00e3o imobili\u00e1ria, nomeadamente designa\u00e7\u00e3o social, NIPC, sede social e n\u00famero de licen\u00e7a AMI junto do IMPIC, I. P.; b) Endere\u00e7o eletr\u00f3nico de contacto da entidade.<\/li>\n<li>O IMPIC, I. P. analisa e valida o modelo de contrato, na sua vers\u00e3o inicial, bem como as ulteriores altera\u00e7\u00f5es, no prazo de 20 dias \u00fateis, contados da sua rece\u00e7\u00e3o.<\/li>\n<li>O prazo referido no n\u00famero anterior suspende-se quando o IMPIC, I. P. solicitar informa\u00e7\u00f5es \u00e0 empresa requerente ou solicitar altera\u00e7\u00f5es ao modelo de contrato, retomando a sua contagem quando esses elementos forem apresentados.<\/li>\n<li>O modelo de contrato com cl\u00e1usulas contratuais gerais n\u00e3o pode ser utilizado enquanto n\u00e3o tiver sido validado, nos termos do disposto nos n\u00fameros anteriores.<\/li>\n<\/ol>\n<h4>Prote\u00e7\u00e3o de dados<\/h4>\n<p>O procedimento de aprova\u00e7\u00e3o pr\u00e9via previsto no presente diploma, quando exigido, deve observar os princ\u00edpios gerais enunciados no\u00a0<a title=\"Link para Regulamento da Uni\u00e3o Europeia\" href=\"https:\/\/dre.pt\/application\/external\/eurolex?16R0679\" target=\"_blank\" rel=\"nofollow noopener\">Regulamento (UE) 2016\/679<\/a>, do Parlamento Europeu e do Conselho, de 27 de abril de 2016, e restante legisla\u00e7\u00e3o aplic\u00e1vel, no que diz respeito ao tratamento de dados pessoais.<\/p>\n<h4>Empresas de media\u00e7\u00e3o imobili\u00e1ria isentas<\/h4>\n<p>As empresas de media\u00e7\u00e3o imobili\u00e1ria que tenham celebrado contratos aprovados pela Dire\u00e7\u00e3o-Geral do Consumidor nos termos do disposto no artigo 16.\u00ba da\u00a0<a title=\"Lei n.\u00ba 15\/2013\" href=\"https:\/\/dre.pt\/web\/guest\/pesquisa\/-\/search\/257806\/details\/normal?l=1\" target=\"_blank\" rel=\"nofollow noopener\">Lei n.\u00ba 15\/2013<\/a>, de 8 de fevereiro, n\u00e3o est\u00e3o obrigadas a submeter nova aprova\u00e7\u00e3o de contrato desde que este n\u00e3o tenha havido nenhuma altera\u00e7\u00e3o do mesmo.<\/p>\n<h3>Conclus\u00e3o<\/h3>\n<p>As\u00a0cl\u00e1usulas <strong>contratuais gerais<\/strong> dos contratos de media\u00e7\u00e3o imobili\u00e1ria<strong>,<\/strong>\u00a0determinadas pela lei , n\u00e3o podem ser negociadas nem alteradas. O cliente da imobili\u00e1ria limita-se a aceitar ou recusar as cl\u00e1usulas pr\u00e9-elaboradas. As empresas de media\u00e7\u00e3o imobili\u00e1ria que optarem\u00a0pelo modelo de contrato aprovado por lei, ficam dispensadas de submeter a aprova\u00e7\u00e3o pr\u00e9via.<\/p>\n<blockquote>\n<h5>Anexo<\/h5>\n<p><strong>Modelo de contrato de media\u00e7\u00e3o imobili\u00e1ria com cl\u00e1usulas contratuais gerais\u00a0<\/strong><span style=\"font-size: 8pt;\">(a que se refere o artigo 2.\u00ba, n.\u00ba 1 \/ portaria 228.2018)<\/span><\/p>\n<p><span style=\"font-size: 10pt;\"> Contrato de media\u00e7\u00e3o imobili\u00e1ria n.\u00ba___\/___<\/span><\/p>\n<p>Entre<\/p>\n<p>___, com sede social na ___, com o capital social de ___ Euros, e com o NIPC ___, matriculada na Conservat\u00f3ria do Registo Comercial de ___, sob o n.\u00ba ___, detentora da licen\u00e7a AMI n.\u00ba ___, emitida pelo Instituto dos Mercados P\u00fablicos, do Imobili\u00e1rio e da Constru\u00e7\u00e3o I. Identifica\u00e7\u00e3o do Neg\u00f3cio<\/strong><\/p>\n<p>1 - A Mediadora obriga-se a diligenciar no sentido de conseguir interessado na __ Compra ___ Trespasse ___ Arrendamento ___, pelo pre\u00e7o de ___ Euros (___), desenvolvendo para o efeito a\u00e7\u00f5es de promo\u00e7\u00e3o e recolha de informa\u00e7\u00f5es sobre os neg\u00f3cios pretendidos e caracter\u00edsticas dos respetivos im\u00f3veis.<\/p>\n<p>2 - Qualquer altera\u00e7\u00e3o ao pre\u00e7o fixado no n\u00famero anterior dever\u00e1 ser comunicada de imediato e por escrito \u00e0 Mediadora.<\/p>\n<p><strong>Cl\u00e1usula 3.\u00aa - \u00d3nus e Encargos<\/strong><\/p>\n<p>O im\u00f3vel encontra-se livre de quaisquer \u00f3nus ou encargos.<\/p>\n<p>OU<\/p>\n<p>O Segundo Contratante declara que sobre o im\u00f3vel descrito na cl\u00e1usula 1.\u00aa recaem os seguintes \u00f3nus e encargos (hipotecas e penhoras) ___, pelo valor de ___ Euros.<\/p>\n<p><strong>Cl\u00e1usula 4.\u00aa - Remunera\u00e7\u00e3o<\/strong><\/p>\n<p>1 - A remunera\u00e7\u00e3o s\u00f3 ser\u00e1 devida se a Mediadora conseguir interessado que concretize o neg\u00f3cio visado pelo presente contrato, nos termos e com as exce\u00e7\u00f5es previstas no artigo 19.\u00ba da\u00a0<a title=\"Lei n.\u00ba 15\/2013\" href=\"https:\/\/dre.pt\/web\/guest\/pesquisa\/-\/search\/257806\/details\/normal?l=1\" target=\"_blank\" rel=\"nofollow noopener\">Lei n.\u00ba 15\/2013<\/a>, de 8 de fevereiro.<\/p>\n<p>2 - Obten\u00e7\u00e3o de Documentos<\/strong><\/p>\n<p>1 - No \u00e2mbito do presente contrato, a Mediadora, na qualidade de mandat\u00e1ria sem representa\u00e7\u00e3o, obriga-se a prestar os servi\u00e7os conducentes \u00e0 obten\u00e7\u00e3o da documenta\u00e7\u00e3o necess\u00e1ria \u00e0 concretiza\u00e7\u00e3o do(s) neg\u00f3cio(s) visado(s) pela media\u00e7\u00e3o.<\/p>\n<p>2 - Garantias da Atividade de Media\u00e7\u00e3o<\/strong><\/p>\n<p>Para garantia da responsabilidade emergente da sua atividade profissional, a Mediadora celebrou um contrato de seguro obrigat\u00f3rio de responsabilidade civil no valor de ___ Euros, ap\u00f3lice n.\u00ba ___, atrav\u00e9s da seguradora ___.<\/p>\n<p><strong>Cl\u00e1usula 8.\u00aa - Prazo de Dura\u00e7\u00e3o do Contrato<\/strong><\/p>\n<p>O presente contrato tem uma validade de ___ (dias\/meses) contados a partir da data da sua celebra\u00e7\u00e3o renovando-se automaticamente por iguais e sucessivos per\u00edodos de tempo, caso n\u00e3o seja denunciado por qualquer das partes contratantes atrav\u00e9s de carta registada com aviso de rece\u00e7\u00e3o ou outro meio equivalente, com a anteced\u00eancia m\u00ednima de 10 dias em rela\u00e7\u00e3o ao seu termo.<\/p>\n<p><strong>Cl\u00e1usula 9.\u00aa - Dever de Colabora\u00e7\u00e3o e Obriga\u00e7\u00f5es do Segundo Contratante<\/strong><\/p>\n<p>1 - O Segundo Contratante colaborar\u00e1 com a Mediadora na entrega de todos os elementos julgados necess\u00e1rios e \u00fateis no prazo de ___ dias, a contar da data de assinatura do presente contrato.<\/p>\n<p>2 - O Segundo Contratante declara e garante que, no \u00e2mbito das disposi\u00e7\u00f5es legais aplic\u00e1veis de natureza preventiva e repressiva de combate ao branqueamento de capitais e ao financiamento do terrorismo, e em rela\u00e7\u00e3o a todos os atos e opera\u00e7\u00f5es abrangidas pelo presente contrato, se obriga a cooperar na disponibiliza\u00e7\u00e3o de informa\u00e7\u00e3o relevante \u00e0 Mediadora, designadamente sobre a identidade das partes contratantes, do objeto do neg\u00f3cio imobili\u00e1rio e dos meios de pagamento das transa\u00e7\u00f5es imobili\u00e1rias.<\/p>\n<p>3 - O Segundo Contratante obriga-se ainda a cumprir todas as disposi\u00e7\u00f5es legais e regulamentares decorrentes do Sistema de Certifica\u00e7\u00e3o Energ\u00e9tica, designadamente a obriga\u00e7\u00e3o de providenciar, nos termos e prazos devidos, pela emiss\u00e3o do respetivo Certificado Energ\u00e9tico em rela\u00e7\u00e3o ao im\u00f3vel objeto do presente contrato (se aplic\u00e1vel).<\/p>\n<p>4 - O Segundo Contratante obriga-se, tamb\u00e9m, a dar cumprimento \u00e0s regras referentes \u00e0 Ficha T\u00e9cnica da Habita\u00e7\u00e3o, nos termos do disposto no\u00a0<a title=\"Decreto-Lei n.\u00ba 68\/2004\" href=\"https:\/\/dre.pt\/web\/guest\/pesquisa\/-\/search\/211028\/details\/normal?l=1\" target=\"_blank\" rel=\"nofollow noopener\">Decreto-Lei n.\u00ba 68\/2004<\/a>, de 25 de mar\u00e7o, nos termos e prazos devidos (se aplic\u00e1vel).<\/p>\n<p><strong>Cl\u00e1usula 10.\u00aa - Angariador Imobili\u00e1rio<\/strong><\/p>\n<p>Na prepara\u00e7\u00e3o do presente contrato de media\u00e7\u00e3o imobili\u00e1ria colaborou o angariador imobili\u00e1rio (nome) ___, portador do Cart\u00e3o de Cidad\u00e3o\/Bilhete de Identidade n.\u00ba ___ e\/ou Contribuinte Fiscal n.\u00ba___.<\/p>\n<p><strong>Cl\u00e1usula 11.\u00aa - Foro Competente<\/strong><\/p>\n<p>Para dirimir quaisquer lit\u00edgios emergentes da execu\u00e7\u00e3o do presente contrato, as partes acordam entre si estabelecer como competente o Foro da Comarca de ___, com a expressa ren\u00fancia a qualquer outro.<\/p>\n<p>(Esta cl\u00e1usula \u00e9 facultativa e s\u00f3 dever\u00e1 ser preenchida se as partes assim o pretenderem e acordarem.)<\/p>\n<p><strong>Cl\u00e1usula 12.\u00aa - Resolu\u00e7\u00e3o Alternativa de Lit\u00edgios<\/strong><\/p>\n<p>1 - Nos termos do disposto no artigo 18.\u00ba da\u00a0<a title=\"Lei n.\u00ba 144\/2015\" href=\"https:\/\/dre.pt\/web\/guest\/pesquisa\/-\/search\/70215248\/details\/normal?l=1\" target=\"_blank\" rel=\"nofollow noopener\">Lei n.\u00ba 144\/2015<\/a>, de 8 de setembro, na reda\u00e7\u00e3o atual, em caso de lit\u00edgio ou insatisfa\u00e7\u00e3o com o servi\u00e7o prestado poder\u00e1 o Segundo Contratante recorrer ao Centro de resolu\u00e7\u00e3o alternativa de lit\u00edgios de consumo___ com o s\u00edtio eletr\u00f3nico na Internet ___, de que a Mediadora \u00e9 aderente.<\/p>\n<p>2 - Limites aos pagamentos em numer\u00e1rio<\/strong><\/p>\n<p>Os intervenientes no presente contrato abst\u00eam-se de celebrar ou de algum modo participar em quaisquer neg\u00f3cios de que, no \u00e2mbito da sua atividade profissional, resulte a viola\u00e7\u00e3o dos limites \u00e0 utiliza\u00e7\u00e3o de numer\u00e1rio, previstos no artigo 63.\u00ba-E da Lei Geral Tribut\u00e1ria, aprovada pelo\u00a0<a title=\"Decreto-Lei n.\u00ba 398\/98\" href=\"https:\/\/dre.pt\/web\/guest\/pesquisa\/-\/search\/191558\/details\/normal?l=1\" target=\"_blank\" rel=\"nofollow noopener\">Decreto-Lei n.\u00ba 398\/98<\/a>, de 17 de dezembro, aditado pela\u00a0<a title=\"Lei n.\u00ba 92\/2017\" href=\"https:\/\/dre.pt\/web\/guest\/pesquisa\/-\/search\/108030505\/details\/normal?l=1\" target=\"_blank\" rel=\"nofollow noopener\">Lei n.\u00ba 92\/2017<\/a>, de 22 de agosto, e de acordo com o artigo 10.\u00ba da\u00a0<a title=\"Lei n.\u00ba 83\/2017\" href=\"https:\/\/dre.pt\/web\/guest\/pesquisa\/-\/search\/108021178\/details\/normal?l=1\" target=\"_blank\" rel=\"nofollow noopener\">Lei n.\u00ba 83\/2017<\/a>, de 18 de agosto.<\/p>\n<p><strong>Cl\u00e1usula 14.\u00aa - Prote\u00e7\u00e3o de Dados Pessoais<\/strong><\/p>\n<p>1 - Em cumprimento do disposto no\u00a0<a title=\"Link para Regulamento da Uni\u00e3o Europeia\" href=\"https:\/\/dre.pt\/application\/external\/eurolex?16R0679\" target=\"_blank\" rel=\"nofollow noopener\">Regulamento (EU) 2016\/679<\/a>\u00a0do Parlamento Europeu e do Conselho, de 27 de abril (RGPD), e demais legisla\u00e7\u00e3o aplic\u00e1vel, no que diz respeito ao tratamento de dados pessoais e \u00e0 livre circula\u00e7\u00e3o desses dados, o Segundo Contratante ___ autoriza\/___ n\u00e3o autoriza que os seus dados pessoais recolhidos, transmitidos ou processados informaticamente pela Mediadora sejam incorporados na sua base de dados.
